Does an NSW Structural Landscaping Licence Application Require a 4-Month Police Check?

·8 min read

Yes—for an individual applicant, the NSW Government requires a National Police Check (NPC) no more than 4 months old at application, according to its Structural landscaping work page dated 23 June 2026. The same page says applications can be started through Service NSW for a licence or certificate term of 1, 3 or 5 years. Figures checked 1 October 2026.

When does structural landscaping need a contractor licence?

The NSW Government classifies structural landscaping as work involving external landscape features and non-habitable structures—structures that people cannot live in. The requirements depend on the work and your role:

CheckNSW Government rule
Licence or certificateA licence or certificate is required to do structural landscaping work.
Contractor licenceOne is required to carry out, advertise or contract for building or trade work valued at more than $5,000 in labour and materials, including GST.
Residential building workA licence is required where structural landscaping is carried out under a contract for residential building work.
Unlicensed workIt can lead to a $22,000 fine for an individual or a $110,000 fine for a company under the Home Building Act 1989.

Examples include retaining walls that do not form part of a habitable building, fencing, driveways, paths and other paving, cabanas, pergolas, decks and non-habitable shelters. The legal definition appears in Schedule 4 of the Home Building Regulation 2014.

Structural landscaping falls within the NSW “other building” category of work. Choose the pathway that matches the role you intend to perform.

What should you check before submitting?

Provide accurate information. The NSW Government says providing false or misleading information is a serious offence. A licence obtained using false or misleading information could lead to criminal prosecution, and the licence or certificate may be cancelled.

Check the current NSW Government regulator page before submitting and your policy’s PDS for the insurance cover you hold. Licensing approval and insurance coverage are separate questions.
